These terms are an agreement between you and BeakBrain, which is operated by Dr Cat Black. By downloading or using BeakBrain, you agree to them. If you do not agree, please do not use the app.
What BeakBrain is
BeakBrain is an educational app that helps you learn to identify birds by sight and sound. It is a learning tool, not a field identification service, and it does not guarantee that any identification is correct.
Your account
You can use BeakBrain as a guest. If you create an account, you are responsible for keeping your login details secure and for activity under your account. Tell us at hello@beakbrain.com if you think your account has been used without your permission.
Acceptable use
Please use BeakBrain lawfully and for your own learning. Do not copy, resell, or redistribute the app or its content, attempt to break or misuse the service, or use it in any way that infringes the rights of others.
Free and Pro
BeakBrain is free to start. A Pro subscription unlocks additional packs and features. Where you buy Pro through the Apple App Store or Google Play, the purchase, billing, renewal, and any refund are handled by that store under its own terms. Subscriptions renew automatically unless you cancel in your store account before the renewal date. You manage or cancel a subscription in the store, not in the app.
Your right to cancel
If you are a consumer in the UK or EU, you have statutory cancellation rights for digital purchases. Because a subscription gives you immediate access to digital content, those rights may end once access begins, as the law allows. This does not affect the store's own refund policy or your other mandatory consumer rights.
Content and intellectual property
The BeakBrain app, its design, and its original text belong to BeakBrain. Bird photos and recordings are used under open licences (CC0, CC BY, CC BY-SA) from Wikimedia Commons, iNaturalist, and the Xeno-canto community, and each item is credited to its creator with its licence shown in the app. Taxonomy comes from AviList, and distribution and seasonality data from GBIF.
Third-party links
BeakBrain links to third-party sites such as birding tours and reference sources. We do not control those sites and are not responsible for their content or their terms.
No warranty
BeakBrain is provided as is and as available, for learning. We do not warrant that identifications, calls, or data are complete or accurate, or that the app will always be available or error free. Nothing here removes rights you have that cannot be excluded under the law where you live.
Our liability
To the extent the law allows, BeakBrain is not liable for indirect or unforeseeable loss arising from your use of the app. We do not limit liability for anything that cannot be limited by law, such as death or personal injury caused by our negligence, or fraud. If you are a consumer, your mandatory legal rights are not affected.
Changes
We may update the app and these terms from time to time. For material changes to these terms, we will update the date above and, where appropriate, tell you in the app. Continuing to use BeakBrain after a change means you accept the updated terms.
Ending your use
You can stop using BeakBrain and delete your account at any time from Account, then Delete account. We may suspend or end access if these terms are seriously or repeatedly broken.
Governing law
These terms are governed by the law of the country in which BeakBrain's operator is established. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts.
